Sameer A Khan

Sameer has practiced in United Arab Emirates for the past nine years. He is a Solicitor of the Senior Courts of England and Wales. He read Modern History and Economics at Pembroke College, University of Oxford before completing his legal education. Prior to qualifying as a Solicitor, he had completed the Bar Vocational Course. He was admitted into the Honourable Society of Lincoln’s Inn in 2006 and called to the Bar in 2007. 

Sameer’s main expertise is in the provision of legal services to the design & engineering, construction, industry and information technology sectors. He has advised and represented clients on projects located in United Arab Emirates, Saudi Arabia, Oman, Kuwait, Bahrain and Qatar. 

Sameer has advised and represented clients before various dispute resolution forums, including ICC Arbitrations seated in Abu Dhabi, London and Singapore and DIAC Arbitrations seated in Dubai. He has also supervised local advocates in conducting litigation in the local courts of UAE.

Experience

Design & Engineering

  • Represented a major UK Contractor in an ADCCAC Arbitration seated in Abu Dhabi against a US Architect Firm for claims for misrepresentation and breach of contract related to the construction of a large educational development in Abu Dhabi. The value of the claim was approximately AED 120m. 
  • Advised a UK Design & Engineering Consultancy on claims for defective design put forward by a UAE Developer with respect to the construction of a major five-star hotel in Dubai. 
  • Advised a UK Design & Engineering Consultancy on claims for defective design put forward by a Saudi Conglomerate with respect to the construction of a large food processing factory building near Jeddah, Saudi Arabia. 
  • Advised a Malaysian Contractor on claims for defective design with respect to construction of a major public building in Doha, Qatar.  
  • Advised a UAE Company on defective fit-out works carried out by an Indian Interior Designer/Contractor in its offices in Hyderabad, India.
  • Supervised local advocates in representing in local courts a UAE Architect Firm that was also a main contractor on a project. This was for claim for non-payment made by the sub-contractor.    


Construction

  • Represented an Australian Sub-Contractor in a DIAC Arbitration seated in Dubai against a UAE Main Contractor for claims for extension of time, prolongation costs and variations in relation to the construction of Concourse 2 of Dubai International Airport. 
  • Represented a UAE Developer in a DIAC Arbitration seated in Dubai against a Chinese Contractor over a dispute related to the construction of a Residential Tower in Dubai Marina.
  • Represented a US Contractor in Dubai World Tribunal proceedings against a UAE Developer for payment of outstanding invoices related to work carried out under a facilities management contract for Palm Jumeirah, Dubai.
  • Advised a UAE Sub-Contractor on its claims for extension of time, prolongation costs and variations in relation to MEP works carried out on Concourse 3 of Dubai International Airport.
  • Advised a UAE Developer on claims put forward by the contractor related to the construction of an office tower in Business Bay, Dubai.
  • Advised a French Contractor on its contractual entitlement against a public body with respect to potential delay claims arising out of a major infrastructure project in Saudi Arabia.


Industry

  • Represented a government entity in an ICC Arbitration seated in London over a dispute related to a gas processing facility in Oman. The claim value was approximately USD 88m and the counterclaim value was USD 25m.  
  • Represented a major Indian Contractor in an ICC Arbitration seated in Abu Dhabi against a UAE entity for claims for extension of time, prolongation costs and variations related to work done on a chemical processing facility in Abu Dhabi. 
  • Represented a Ukranian Contractor in an ICC Arbitration seated in Abu Dhabi against the Government of Fujairah over a dispute arising from an Oil Exploration Contract in Fujairah, UAE.
  • Advised a Dubai Public Authority on claims put forward by a Japanese Contractor related to the construction of a Power Plant.
  • Advised a Kuwaiti Sub-Contractor on claims against a Korean Main Contractor over work done on Power Stations in Kuwait. 
  • Advised a French Sub-Contractor on claims against a Korean Main Contractor over work done on a desalination plant in Bahrain.  


Information Technology 

  • Represented a Pakistani Telecommunications Company in an ICC Arbitration seated in Singapore over a commercial dispute related to sale of licenses. The claim value was USD 25m.
  • Advised a major US Contractor on main contract and sub-contract disputes related to the provision of servers and IT platforms to the Muscat and Salalah International Airports in Oman.
