Commercial litigation
Acting for claimants over properties in Hong Kong and New York valued in excess of US$20 million. Successfully obtained an injunction order over a valuable property situated in Hong Kong to restrain the property being dealt with pending the trust claims being resolved. Worked with offshore law firm resulting in the successful transfer of the New York property to the client.
Acting for a government on its asset tracing efforts in relation to funds misappropriated by various government officials (and their family members and associates). Liaised extensively with the Department of Justice. The value of assets in excess of HK$300 million was successfully traced and restrained.
Employment
Advising Court-appointed Receivers in relation to a global alternative investments firm and multi-jurisdictional disputes resulting from in-fighting between the shareholders and others. Defending claims made in Hong Kong which are valued in excess of USD10 million as well as handling other employee issues, specifically extensive data access requests, and terminations. Leading a team move project for a private bank hiring from a competitor in Hong Kong and Singapore. Providing strategy guidance and managing outside law firms advising individual employees.
Restructuring & Insolvency
Acting for Liquidators of a group of companies in pursuing fraudulent trading and misfeasance claims against company officers as well as professional negligence claims against the former auditors. Former officers of the group were sentenced to 10 years of imprisonment on nine counts of charges for defrauding a number of banks. Their fraudulent act has led to the insolvency of the group. The various pieces of ongoing litigation are currently being funded by a litigation funder.
